PUPPY CONTRACT

The Breeder Agrees:
That this puppy is in good health at the time of sale. The buyer will have 72hrs in which to have the puppy examined by their own veterinarian. If the puppy is found to be ill by a licensed veterinarian and is to be returned due to illness, a letter from the terinarian is required. This includes death or illness from any health condition deemed to be present prior to the leaving the seller’s premises. Buyer shall assume any expenses associated with returning the puppy to the seller. The seller will, at the seller's discretion, refund the purchase price, return the dog to the buyer in healthy condition, OR exchange the dog for another dog of equal value. At no time and under no circumstances will the Breeder be responsible for any veterinary expenses incurred by the buyer.

This animal is warranted against fatal genetic defects for 1 year from the date of purchase. Should this puppy be determined to be suffering from a fatal defect deemed to be hereditary (within 1 year from the date of purchase), breeder will replace the puppy with one of the same value when one is available after notification and written verification has been furnished to the Breeder by TWO independent veterinarians. The breeder will not be responsible for any veterinary costs at any time.
We cannot guarantee that your puppy will never develop any health problems, just as a pediatrician cannot guarantee that a child will never develop any health problems in the future. Some things are just not able to be predicted. Our parents are free of diseases, disorders, and health problems; otherwise we would not breed them. That means our puppies are less likely to develop problems. If anything does occur, you are required to inform us so we can evaluate the parents and the other puppies from that litter in an attempt to determine the cause of the ailment and to eliminate the issue from our breeding program.

The Breeder states that the puppy has received vaccines in accordance with their family veterinarian as of the date of the adoption.  The attached schedule of vaccinations and treatments is required to be maintained by the purchaser to be in compliance with the 1 year health guarantee.

The Buyer Agrees:
That this puppy will be given adequate and proper shelter and housed securely indoors. This dog shall not be neglected, allowed to roam free, or be mistreated in any manner. The puppy shall receive proper veterinary care throughout its life, receiving annual inoculations and placed on a heart worm preventative. The puppy shall receive proper nutrition and care shall be taken to maintain its proper weight. Buyer agrees to give the dog proper training and socialization. Buyer agrees to never sell or surrender this dog into a dog fighting institution, testing center or shelter.

The Buyer agrees to finish all puppy vaccines before taking their puppy out in public, letting their puppy on public sidewalks and grasses, or letting their puppy be touched by people outside of the family. This reduces the chance of your puppy picking up a communicable disease such as parvo.

The Buyer agrees to spay/neuter the puppy at the age their Vet recommends, and provide the seller documentation.  The seller recommends waiting until the puppies growth plates have closed if possible.

The Buyer agrees to return the dog to the Breeder if for any reason the Buyer no longer wants to or is unable to keep the dog. Breeder agrees to either assist Buyer in finding another suitable home where the dog will receive proper care or to accept the dog back at any time with no refund to be given to the Buyer as Breeder would accept responsibility for the dog and will be responsible for the future cost of care including vet care and training. The Buyer will notify the Breeder of any changes of address and will maintain contact with the seller throughout the life of this dog.

By signing below, both parties, Breeder and Buyer, agree to abide by the contents of this contract.

guardian Contract Female

Guardian Contract

Doodle Dudes and Dolls Guardian Home Program grants qualified families/individuals guardianship of a breeding (male or female) puppy/dog.  Doodle Dudes and Dolls (Breeder) grants Guardian Home Family (Guardian) sole ownership of the dog at the end of the contract period, which will conclude before the female dog turns 6 or after up to 5 breeding cycles producing puppies, usually 4 (number of litters to be determined by Breeder, depending on how the dog does with birthing and raising puppies and how well she recovers after having a litter).  Strong, robust dogs may be bred 2 consecutive heats, then have a break.

Guardian agrees to abide by the terms below, the only exceptions to agreement to be noted in writing with Breeder.   Guardian responsibilities and Breeder obligations are provided below.  Guardian’s failure to fulfill these responsibilities can result in Breeder terminating the guardianship agreement and Guardian will be required to return the dog to Breeder. Should the Breeder need to seek legal action against the Guardian for violations of this agreement, the Guardian will assume any and all attorney costs and court fees.

Guardian Responsibilities

  1. Guardian will provide home to dog with fenced yard and will keep dog in fenced yard or on leash at all times.  Guardian will notify Breeder 30 days in advance of change of address or move, and must stay in the general vicinity of first address/city for agreement to continue with Breeder.  Guardian will inform Breeder of vacations or planned absences.  Or the dog can be brought to the breeder to stay for the duration of the absence for a nominal kennel fee.  Guardian is responsible to ensure that all persons residing with Guardian and dog understand and abide by the terms of this contract.

  2. Guardian is responsible for properly maintaining, containing, training and caring for the dog using methods approved by the Breeder.  This includes providing high-quality dog food and exercising the dog .  Dog must be trained with basic commands for sit; stay, come, down.  Dog will not be left outdoors during extreme weather conditions and will never be chained.

  3. Guardian will provide and pay for routine veterinary care including sick and well checkups, and will inform Breeder (emailing vet reports and records).  Guardian will provide required immunization boosters, rabies immunization, monthly heartworm preventative, monthly flea/tick preventative treatments and other routine health checkups and treatments.  Guardian will maintain the dog’s physical appearance with grooming, brushing and de-matting. Guardian will keep nails clipped, and clean ears and teeth.  Guardian will notify Breeder immediately with any health concerns, illnesses, accidents, etc.

Guardian will provide Breeder with the name, address and telephone numbers for their veterinarian.  Guardian will send Breeder copies of all exams and vet records after the vet visits.

  1. Guardian is responsible for seeking prompt and appropriate veterinary care in the event of injury or illness of the dog.  If choices need to be made regarding type of treatment, these choices must be presented to and made by the Breeder unless emergency treatment is required.

  2. Guardian will be responsible for routine vet costs and treatment for accidents or injury.  If genetic health problems arise (patella, hips, severe heart problems) Guardian will not be responsible for costs to treat these issues.  Dog with severe genetic faults will not be bred and Guardian/Breeder will work out Guardian keeping/not keeping the dog and payment for treatment, depending on the problem.

  3. Guardian will surrender dog to Breeder when requested and on occasions such as, breeding, whelping, and vet visits for testing and certifications. Guardian will assist Breeder to transport dog for breeding and whelping, to deliver and to pick up or meet 1/2 way if needed.

  4. Guardian will be required to pay Breeder $5000 if the dog dies due to gross negligence on the part of the Guardian.  Negligence is defined as but not limited to: (1) failure to responsibly contain or supervise the dog (resulting in injury or death) (2) leaving the dog alone in a vehicle if the outdoor temperature is over 60 degrees; (3) failure to prevent the dog from having access to toxic materials;  (4) failure to provide containment of dog while in a moving vehicle (crate) if not contained inside the vehicle (ie pickup bed).  If the dog dies due to accident beyond the control of the Guardian, the Guardian does not owe payment to the Breeders.  If the dog dies due to non-treatable or genetic health issue, the Guardian will not be held responsible in any way.  If the dog disappears during the contract period, Guardian will pay Breeder $5000.

  5. Guardian of a female will check the dog for signs of beginning heat cycles as per instruction by Breeder.  The Guardian will notify Breeder when changes indicating impending heat cycles appear, and Breeder will let Guardian know when to meet /deliver the dog for breeding.  Guardian must deliver the dog to Breeder on the date Breeder specifies.

For non-breeding heat cycles, the Guardian agrees not to let the dog outside (even in a fenced yard) alone. The Guardian also agrees not to allow any intact males inside their house while the female is in heat, unless both dogs are on leash and kept apart. The Guardian must refrain from taking the female out in public while she’s in heat, in order to protect both the dog and yourself from aggressive dogs.

  1. For whelping, the dog will be kept by Breeder (approximately 4-5 days before litter’s due date), and will go home after the puppies are weaned (when the puppies are approximately 6-8 weeks of age, to be determined by Breeder).

  2. Guardian of a female will allow the Breeder up to 5 successful breedings.  A “successful breeding” is a litter with more than one puppy.  Breeder will determine the number of litters for this contract, not to exceed 6 litters.

  3. Guardian may return the dog to Breeder at any time, for any reason and the guardianship agreement will be terminated.
